Terms of Service

These Terms of Service (hereinafter referred to as the "Terms") define the conditions for using the services (hereinafter referred to as the "Service") provided by BrewTune (hereinafter referred to as the "App"). All users (hereinafter referred to as "Users") must agree to and comply with these Terms to use the Service.

Article 1 (Applicability)

These Terms apply to any and all relationships between the User and the App regarding the use of the Service.

Article 2 (User Registration)

1. Registration is completed when a registration applicant agrees to these Terms, applies for registration in the manner specified by the App, and the App approves the application.
2. The App reserves the right to reject any application for registration if it determines that the applicant has met any of the following conditions. The App is under no obligation to disclose the reason for rejection:
   • False information was provided during the application process.
   • The applicant has previously violated these Terms.
   • Any other reason that makes registration inappropriate in the App's judgment.

Article 3 (User ID and Password Management)

1. Users are responsible for properly managing their User ID and Password (including linked third-party social logins) for the Service under their own responsibility.
2. Under no circumstances may a User transfer, lend, or share their User ID and Password with a third party.
3. If a login attempt succeeds with a User ID and Password combination that matches the registered information, it will be deemed as used by the User who registered that User ID.

Article 4 (Prohibited Activities)

Users shall not engage in any of the following acts when using the Service:

• Acts that violate laws, regulations, or public order and morals.
• Acts related to criminal behavior.
• Acts that infringe upon copyrights, trademarks, or other intellectual property rights contained in the Service.
• Acts that destroy or interfere with the functionality of the App's servers or network.
• Commercial use of information obtained through the Service.
• Acts that may interfere with the operation of the Service.
• Unauthorized access or attempting unauthorized access.
• Collecting or accumulating personal information of other Users.
• Impersonating other Users.
• Other acts deemed inappropriate by the App.

Article 5 (Suspension of the Service)

1. The App may suspend or interrupt the provision of all or part of the Service without prior notice to Users in the event of any of the following:
   • Maintenance, inspection, or updates of the computer system related to the Service.
   • Force majeure such as earthquakes, lightning, fire, power outages, or natural disasters.
   • Accidental shutdown of computers or communication lines.
   • Any other cases where the App deems it difficult to provide the Service.
2. The App shall not be liable for any disadvantage or damage suffered by Users or third parties due to the suspension or interruption of the Service.

Article 6 (Disclaimer of Warranties and Limitation of Liability)

1. The App does not warrant, either express or implied, that the Service is free from de facto or legal defects (including safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security defects, errors, bugs, or infringement of rights).
2. The App shall not be liable for any damages incurred by Users arising from the Service, except in cases of intentional misconduct or gross negligence by the App.
3. The App is not responsible for any transactions, communications, or disputes arising between Users and other Users or third parties in connection with the Service.

Article 7 (Changes to Service Content)

The App reserves the right to change the contents of the Service or discontinue the provision of the Service without prior notice to Users, and shall not be liable for any damages incurred by Users as a result.

Article 8 (Modifications of the Terms of Service)

The App reserves the right to modify these Terms at any time without prior notice to Users. If a User continues to use the Service after the modification of these Terms, the User is deemed to have agreed to the modified Terms.

Article 9 (Governing Law and Jurisdiction)

1. These Terms shall be governed by and construed in accordance with the laws of Japan.
2. In the event of a dispute arising in connection with the Service, the court having jurisdiction over the location of the App's operator shall have exclusive agreed jurisdiction.
